You MUST have his Social Security Number to put on the form, but you are eligible to claim him. Page 17 of the instructions for form 1040 states that if you do not specify the child’s social security number, the exemption will be disallowed and other benefits (like the child tax credit) will be reduced or disallowed.
The IRS rules (on page 14 of Publication 501) say that if your son was born during 2007, you should report that he lived with you for the entire year.
No as soon as your baby is born you can claim him on your taxes. He was born in 2007 that is all what counts. Congratulation on your little bundle.
the IRS probably prorates the deduction, depending on how many days of the year he existed, in this case 2. yes, you do need his SS no. go ahead and file with no SS and giving date of birth, just to establish the record for next year’s return.
Even though your baby was born on the next to the last day of 2007, you can claim him for the entire year. The IRS allows you to claim them for the entire year, but only if you provide a social security number for them. If by April 15th you still have not received a SSN for your baby, you can file a request for an extension – Form 4868, Application for Automatic Extension of Time to File U.S. Individual Income Tax Return. This will give you an additional four months to file a return.
However, if memory serves me correctly, I received a SSN for my son (born December 24th of 2000) in just a few weeks after his birth, so it shouldn’t take long for you.
Congratulations on your new baby, by the way!
Of course you can deduct him on your taxes. He has lived with you for 9 months….if life starts at conception then he has lived with you for most of the year more than the 6 months requirement ! so enjoy the child tax credit for the newborn …..
Yes, you can claim your baby. If they are born on the 31st of December they are still counted by the IRS as having been under your roof for a full year. When the baby was born the doctor should have filled out a birth certificate, the bottom part of the certificate should have been turned in to Social Security and it takes about six weeks for your card for the baby to get to you. Call Social
Security and see if it is in processing; they can give you the number on the phone before you receive the card so you can file your tax return.
